1) Acceptance of Terms
By downloading, accessing, or using our application(s) (the “App”) or this website (collectively, the “Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.
2) No Medical Advice
The Services are for educational and informational purposes only. The Services do not provide medical advice, diagnosis, or treatment, and your use does not create a physician–patient relationship. You must exercise independent clinical judgment and comply with your institution’s policies, professional standards, and applicable laws. This applies equally to any AI-generated output, which may be inaccurate and must be independently verified.
3) Not for Emergencies
Do not use the Services for medical emergencies. In an emergency, follow your institution’s protocols and contact emergency services.
4) Intended Users
The App is intended for healthcare professionals and educated users familiar with the limitations of medical references. Non-professional users should consult a qualified clinician before relying on any information.
5) No PHI / Data You Provide
Do not enter protected health information (PHI) (e.g., patient names, MRNs, DOBs). If you input any data, you represent that you have the right to do so and that it contains no PHI. You are responsible for complying with HIPAA and other privacy laws applicable to your use.
6) Clinical Calculators & Content
Values, equations, dosages, risk scores, and guidance provided by the App may be incomplete or outdated and may not reflect patient-specific factors or local standards. All outputs are estimates and must be verified against authoritative references and institutional policies.
7) No FDA Clearance/Approval
The App is provided as an educational clinical decision support/reference tool and is not an FDA-cleared medical device.
8) License & Acceptable Use
We grant you a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You may not reverse engineer, scrape, or copy content; distribute or resell the App or its content without permission; use the App to provide medical care, diagnostics, or treatment advice; or use the App in violation of law or third-party rights.
9) Intellectual Property
All content, features, and functionality are owned by Apio LLC or its licensors and protected by intellectual property laws. You may display and use the content solely within the App for its intended purpose.
10) Updates; Availability
We may update, modify, or discontinue the Services or any feature without notice. We do not guarantee availability, accuracy, or completeness.
11) Third-Party Content & Links
The Services may reference third-party content or link to third-party sites. We do not endorse or control such content and are not responsible for it.
12) Subscriptions, Billing & Automatic Renewal
If you choose to subscribe for access to premium features (a “Subscription”), the following terms apply:
- Subscription Options, Pricing & Duration: You may select from the following options (as of the Effective Date):
• Monthly Premium Subscription: USD 3.99 per month (includes the Trace AI assistant)
• Annual Premium Subscription: USD 39.99 per year (includes the Trace AI assistant)
• Lifetime Access (one-time purchase): USD 199.99 — unlocks premium content only; the Trace AI assistant requires an active Premium subscription and is not included. - Automatic Renewal & Charges: Your Subscription will automatically renew at the end of each subscription period (monthly or yearly) unless auto-renewal is turned off at least 24 hours before the end of the then-current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.
- Cancellation & Management: You can manage, change, or cancel your Subscription and auto-renewal settings via your Apple ID account settings after purchase. Once canceled, the Subscription will remain active until the end of the current paid period. There is no refund for the remaining time in the current subscription period, except as required by applicable law or Apple’s refund policies.
- Free Trial (if applicable): If we offer a free trial period, any unused portion of the free trial (if offered) will be forfeited when you purchase a Subscription, if applicable.
- Billing via Apple: All billing and payments are handled through Apple’s in-app purchase system. Apple’s terms apply. You agree that Apple processes all payments, renewals, and cancellations. We have no direct access to your payment information.
13) Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. API O LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. YOUR USE IS AT YOUR OWN RISK.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, API O LLC AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE Services OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.
15) Indemnification
You agree to indemnify and hold harmless Apio LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or violation of any law or third-party rights.
16) Professional Responsibility
You acknowledge that you are solely responsible for all clinical decisions and for verifying information obtained from the App with independent sources and your institution’s protocols.
17) Governing Law; Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania for disputes not subject to mandatory arbitration or where arbitration is not permitted.
18) Changes to Terms
We may update these Terms at any time. If we make changes, we will post a revised version with a new “Effective Date.” Continued use after changes become effective constitutes acceptance of the updated Terms.
19) Trace AI Assistant
If you use the Trace AI assistant: (a) responses are generated by a third-party AI model (Anthropic) and may be inaccurate, incomplete, or outdated and must be independently verified; (b) Trace does not provide drug doses and is not a substitute for professional judgment, institutional policy, or primary literature; (c) you must not enter patient identifiers or PHI; and (d) AI features are subject to fair-use limits and may change or become unavailable. The de-identified inputs you submit are processed as described in our Privacy Policy.
20) Apple App Store
These Terms are between you and Apio LLC only, not with Apple, and Apple is not responsible for the App or its content. The license granted is limited to use on Apple-branded devices you own or control per the App Store Terms of Service. Apple has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (to the extent applicable); Apple has no other warranty obligation. Apio LLC, not Apple, is responsible for addressing any claims relating to the App (including product-liability, regulatory, consumer-protection, and intellectual-property claims). You represent that you are not located in an embargoed country or on a U.S. government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

Privacy Policy

1) Introduction
This Privacy Policy explains what information our application (the "App") and website collect, how it is used, and your choices. The App is not intended to collect, store, or transmit protected health information (PHI).
2) Information We Do Not Collect
- We do not collect names, dates of birth, medical record numbers, or other identifiers.
- We do not collect or store PHI subject to HIPAA.
- We do not share personal information with third parties for advertising or marketing.
3) Information We Handle
- Anonymous identifier: On first launch we create an anonymous identifier (via Firebase Anonymous Authentication) so the service can recognize your device and apply your subscription. It is not linked to your name, email, or real-world identity.
- Trace (AI assistant): If you use Trace, the App sends to our server and to our AI provider (Anthropic) the de-identified case parameters you set (such as room, weight, age, procedure, and flags) and the questions you type, in order to generate a response. The App deliberately excludes the free-text label field and other identifiers. We log only aggregate usage metrics (token counts and estimated cost) to operate the service fairly. Per Anthropic's commercial API terms, inputs and outputs are not used to train their models. Do not enter PHI into Trace.
- Your content (case cards, notes, favorites): Stored on your device and backed up to your own iCloud account (Apple iCloud Key-Value storage) so it persists and syncs across your devices. This data resides in your iCloud account; we do not have access to it.
- Subscription data: Transactions are processed by Apple; we never receive your payment-card details. We store a randomly generated subscription-linking token and your entitlement status (e.g., whether Premium is active) to manage access and restore purchases.
- Device integrity: We use Apple App Attest / Firebase App Check to confirm requests come from a genuine, unmodified copy of the App. This protects the service from abuse and does not identify you.
- Support inquiries: If you email us, we retain your email address and correspondence for support purposes only.
We do not use analytics, advertising, tracking technologies, the device advertising identifier (IDFA), or crash-reporting SDKs. The App uses only Apple (StoreKit/iCloud) and Google Firebase (Authentication, Firestore, App Check), plus Anthropic for AI processing. If this ever changes, we will update this Policy and the App Store privacy labels.
4) How We Use Information
- To operate and maintain the App and website.
- To troubleshoot bugs, crashes, or errors.
- To improve features, calculators, and educational content.
- To process subscription validation (if applicable).
- To respond to user inquiries or support requests.
5) Data Storage & Security
Most data you enter stays on your device or in your own iCloud account. When you use Trace, the de-identified inputs described above are transmitted to our server and AI provider to generate a response. We implement reasonable safeguards (device attestation, server-side authorization, and encryption in transit), but no method of storage or transmission is 100% secure.
6) Third-Party Services
The App relies on Apple (App Store billing and iCloud storage of your content), Google Firebase (anonymous authentication, database, and App Check), and Anthropic (AI processing of de-identified Trace inputs). Each is governed by its own privacy terms. We do not use advertising or analytics services.
7) Children’s Privacy
The App is not directed at children under 13 and is designed for healthcare professionals and educational use.
8) No Patient Data / PHI
The App is not designed to collect or transmit PHI. Users are responsible for ensuring compliance with HIPAA and other privacy regulations in their own use.
9) Your Choices
- You may restrict crash reporting or analytics through device privacy settings.
- You may delete the App at any time, which deletes locally stored data.
10) Data Retention
We do not retain personal data beyond what is needed for support or subscription validation. Support emails may be kept as business records and are not used for marketing.
11) International Users
If you access the Services outside the United States, your data may be processed in the U.S.
12) Changes to This Policy
We may update this Privacy Policy from time to time. Updates will be posted here with the "Effective Date" updated accordingly.
