AI Assistant (Trace): Certain features (including the “Trace” assistant) generate responses using a third-party AI model. Trace is an educational aid only. It can produce inaccurate, incomplete, or outdated information (“hallucinations”), has no access to any patient record, does not provide drug doses, and is not a substitute for your independent clinical judgment, institutional policy, or primary literature. Independently verify any AI output before relying on it.

1) Acceptance of Terms

By downloading, accessing, or using our application(s) (the “App”) or this website (collectively, the “Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.

2) No Medical Advice

The Services are for educational and informational purposes only. The Services do not provide medical advice, diagnosis, or treatment, and your use does not create a physician–patient relationship. You must exercise independent clinical judgment and comply with your institution’s policies, professional standards, and applicable laws. This applies equally to any AI-generated output, which may be inaccurate and must be independently verified.

3) Not for Emergencies

Do not use the Services for medical emergencies. In an emergency, follow your institution’s protocols and contact emergency services.

4) Intended Users

The App is intended for healthcare professionals and educated users familiar with the limitations of medical references. Non-professional users should consult a qualified clinician before relying on any information.

5) No PHI / Data You Provide

Do not enter protected health information (PHI) (e.g., patient names, MRNs, DOBs). If you input any data, you represent that you have the right to do so and that it contains no PHI. You are responsible for complying with HIPAA and other privacy laws applicable to your use.

6) Clinical Calculators & Content

Values, equations, dosages, risk scores, and guidance provided by the App may be incomplete or outdated and may not reflect patient-specific factors or local standards. All outputs are estimates and must be verified against authoritative references and institutional policies.

7) No FDA Clearance/Approval

The App is provided as an educational clinical decision support/reference tool and is not an FDA-cleared medical device.

8) License & Acceptable Use

We grant you a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You may not reverse engineer, scrape, or copy content; distribute or resell the App or its content without permission; use the App to provide medical care, diagnostics, or treatment advice; or use the App in violation of law or third-party rights.

9) Intellectual Property

All content, features, and functionality are owned by Apio LLC or its licensors and protected by intellectual property laws. You may display and use the content solely within the App for its intended purpose.

10) Updates; Availability

We may update, modify, or discontinue the Services or any feature without notice. We do not guarantee availability, accuracy, or completeness.

The Services may reference third-party content or link to third-party sites. We do not endorse or control such content and are not responsible for it.

If you choose to subscribe for access to premium features (a “Subscription”), the following terms apply:

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. API O LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. YOUR USE IS AT YOUR OWN RISK.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, API O LLC AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE Services OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

15) Indemnification

You agree to indemnify and hold harmless Apio LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or violation of any law or third-party rights.

16) Professional Responsibility

You acknowledge that you are solely responsible for all clinical decisions and for verifying information obtained from the App with independent sources and your institution’s protocols.

17) Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania for disputes not subject to mandatory arbitration or where arbitration is not permitted.

18) Changes to Terms

We may update these Terms at any time. If we make changes, we will post a revised version with a new “Effective Date.” Continued use after changes become effective constitutes acceptance of the updated Terms.

19) Trace AI Assistant

If you use the Trace AI assistant: (a) responses are generated by a third-party AI model (Anthropic) and may be inaccurate, incomplete, or outdated and must be independently verified; (b) Trace does not provide drug doses and is not a substitute for professional judgment, institutional policy, or primary literature; (c) you must not enter patient identifiers or PHI; and (d) AI features are subject to fair-use limits and may change or become unavailable. The de-identified inputs you submit are processed as described in our Privacy Policy.

20) Apple App Store

These Terms are between you and Apio LLC only, not with Apple, and Apple is not responsible for the App or its content. The license granted is limited to use on Apple-branded devices you own or control per the App Store Terms of Service. Apple has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (to the extent applicable); Apple has no other warranty obligation. Apio LLC, not Apple, is responsible for addressing any claims relating to the App (including product-liability, regulatory, consumer-protection, and intellectual-property claims). You represent that you are not located in an embargoed country or on a U.S. government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

1) Introduction

This Privacy Policy explains what information our application (the "App") and website collect, how it is used, and your choices. The App is not intended to collect, store, or transmit protected health information (PHI).

We do not use analytics, advertising, tracking technologies, the device advertising identifier (IDFA), or crash-reporting SDKs. The App uses only Apple (StoreKit/iCloud) and Google Firebase (Authentication, Firestore, App Check), plus Anthropic for AI processing. If this ever changes, we will update this Policy and the App Store privacy labels.

Most data you enter stays on your device or in your own iCloud account. When you use Trace, the de-identified inputs described above are transmitted to our server and AI provider to generate a response. We implement reasonable safeguards (device attestation, server-side authorization, and encryption in transit), but no method of storage or transmission is 100% secure.

6) Third-Party Services

The App relies on Apple (App Store billing and iCloud storage of your content), Google Firebase (anonymous authentication, database, and App Check), and Anthropic (AI processing of de-identified Trace inputs). Each is governed by its own privacy terms. We do not use advertising or analytics services.

7) Children’s Privacy

The App is not directed at children under 13 and is designed for healthcare professionals and educational use.

8) No Patient Data / PHI

The App is not designed to collect or transmit PHI. Users are responsible for ensuring compliance with HIPAA and other privacy regulations in their own use.

We do not retain personal data beyond what is needed for support or subscription validation. Support emails may be kept as business records and are not used for marketing.
